    Monthly General Meetings
are held on the third Thursday of each month (occasional exceptions), at 6:30 pm, at the Crowne Plaza Hotel (main ballroom), on LBJ Freeway (635) at the Coit Road exit, in Dallas. Non-members and visitors are always welcome to attend. No advance registration is required.

    

    Independent investors and landlords serve a vital role in the community. They rejuvenate blighted neighborhoods, add to the tax base, and provide employment for a wide range of workers, contractors and suppliers. But most importantly, they provide the affordable housing which enables so many working Americans to live with dignity, comfort and security. " Federal Requirements for Seller Financing, 2010 "

Yes, it's true. Until next summer, you don't have to be, or use, a licensed Residential Mortgage Loan Originator (RLMO) to do seller financed transactions, as long you don't do more than five seller financed deals in 12 months._

However, you still must comply with all of the new or amended federal laws and regulations regarding seller financing - on every seller financed deal you do. 

o   Do you know all of the disclosure laws?
o   Can you compute APR?    
o   Do you know the current definition of a "high priced loan"? 
o   These are just a few examples of the compliance requirements.

The official notice published last August 17th, announcing the postponement of the requirement for RMLO licensing until next summer, included the following crucial reminder by TDSML Commissioner Doug Foster

"The Department holds the position that exemption from licensing does not relieve that individual from complying with all applicable laws and rules pertaining to disclosures required by RESPA, new GFE, TILA, APR, new HOEPA, High Priced Loans, etc. and the timing of each disclosure and rule".

If you think you might ever do even one seller financed deal any time in the future, then you need to be aware of all the provisions with which you are required to comply - with or without a licensed RMLO involved.

Randy Smith 
Randy Smith started his real estate investing company, VRR Enterprises, llc, (aka EASYHOMEBUYERS) in 1998. His was a builder/developer in the Duncanville area in the 70's and 80's. He built houses with his father and brother for about 5 years, then got out of the business to pursue music.  He played professionally for about 15 years, and along the way, to supplement the band income, was in sales for many years. When he decided to give up music in 1998, at that time the real estate market was very strong. He decided to get back into the business, but didn't want to build like his father had done, because of the disaster we all went through back in the 80's. So he and his wife  decided to get into the flipping of existing houses. Neither of them knew anything about the business other than the fact that Randy had a very strong background in construction and building. They literally learned as they went, without any help or training from outside, and eventually found their way through. To date they have purchased more than 300 single family homes, have owner financed many of them, have a current inventory of 28 rentals. In October of 2007, they also purchased a commercial building (distressed, of course) near the new Dart rail station in Carrollton, where they currently office. Randy and his wife will celebrate their 19th anniversary on  Monday, July 12th.

Mark Fuller 
Mark Fuller has been an entrepreneur for 20 years and has extensive marketing experience. He started his real estate investment company, Intense Properties, in March of 2006, with the main goal of buying single family homes, fixing them up, and selling retail. Since then he has been involved in more than 100 transactions including both wholesaling and rehabbing. He continues to do both. He specializes in targeted marketing to buy his properties, and he is very experienced in negotiating contracts with sellers. He also deals in 'creative structuring' to buy his properties. He does not buy foreclosed properties or ones that are listed in the MLS, so he gets the best prices. Mark and his wife have been married for 11years and have 3 boys - 11, 6, and 3.
